We will not sell or rent your personal information to third parties for their marketing purposes under any circumstances. If you do not agree with the terms of the data privacy policy, please do not sign up as merchant for our service and do not use our services.

Changes to the data privacy policy

This data privacy policy can be revised in the course of time, if new features are added or suggestions of our customers are implemented. We reserve the right to change this data privacy policy at any time and to post the revised version on our website. The revised version takes effect at the end of a period of 30 days after it has been changed on the website. It is assumed that you have agreed to all changes in the data privacy policy if you continue to use the services after this period.

If you do not agree to the provisions of the privacy policy, you can cancel your account with us as a merchant.

Some sections of our website contain links to third-party websites. These pages are subject to their own data privacy policies. PAYMILL is not responsible for their operation, including data handling. Users who send information to or through such sites of third-party providers should check the data privacy policy of these sites before providing information to them.

It is made clear that this data privacy policy is not a framework agreement within the meaning of the EU Payment Services Directive (2007/64/EC) and the associated implementing laws in the European Union and the EEA. Our services are in line with the legal data protection provisions, which are regulated in the Federal Data Protection Act (BDSG), the German Telemedia Act (TMG) and the Law Against Unfair Competition (UWG).

2. Collected Information

Required Information

To use our service, you must specify your name, address, telephone number, and e-mail address, among other information. To accept payments with PAYMILL, you must specify your bank account details. Furthermore, we need more details about you and your company if you wish to use our service in its entirety. Testing requires only a valid e-mail address and a password.

Under the circumstances, we also ask you to answer several security questions (e.g. your place of birth or your mother’s maiden name). We need this information to process transactions, assign new passwords if you have forgotten your current password, to protect you from credit card and bank account fraud, to carry out corresponding verifications, and to contact you regarding the administration of your account or our services.

Transaction Information

If you use our service, we ask you to request and save information about the transaction, including the price of the transaction, the nature of the transaction (sale of goods, sale of a service, etc) and e-mail address, customer address, IP address, token and telephone number of the customer. We collect the IP address and other information about the computer or the device that you use to access your user account to monitor your account for unauthorized access.

Information about you from third parties

To protect against potential fraud, we check the information provided by you with the help of the payment processor and/or credit agencies listed in the section "Use and disclosure of information". During such verification, we receive personal information about you from such services.

If you owe money to PAYMILL, we are allowed to carry out a review of your credit-worthiness within the scope of the statutory possibilities by obtaining additional information about you from a credit reporting agency. PAYMILL also reserves the right to obtain and check regularly a business and/or customer credit report from such a credit reporting agency for each account, at its discretion, and close accounts on the basis of the information obtained during such credit check procedure.

Additional verification

If we cannot verify the information provided by you or if we need additional information about your company, we ask you to send additional information to us by fax, scanned document or post (such as disclosure of all shareholders, commercial registry extract from less than 3 months ago, credit card statements or other information, associated with the appropriate address) or perform PostIdent. PAYMILL reserves the right, under the circumstances, to conduct an on-site visit your company.

Correspondence with customer service

If you send us correspondence, including e-mails and faxes, we retain such information in the documents for your account. We also store all customer service correspondence and other correspondence addressed to you from PAYMILL. We keep this data to document our customer relationships, to evaluate and improve our customer service and to investigate potential fraud or violations of the provisions of our terms of use. Depending on the legal situation, this data may be deleted after a certain time.

3. Use and disclosure of information

You give us permission to use and save your personal information for the following purposes:

• To provide the services requested by you and customer services
• Clarification of conflicts, collection of fees, troubleshooting problems
• Prevention of potentially illegal or prohibited activities, enforcing our terms and conditions
• Adaptating, evaluating and improving our services
• Comparing information to determine the accuracy and validation with the help of third parties

Disclosure of customer information by the merchant

Please note that merchants you buy from and with whom you enter into a contract may have their own data privacy policies and PAYMILL is not liable for their application and procedure. Your information can be collected there under data privacy policies of another third party.

Disclosure of data to third parties

PAYMILL does not sell or rent any personal data to third parties for their marketing purposes. A disclosure is made solely for the purposes described in this policy. You expressly consent and instruct PAYMILL to take the following measures:

• Disclosure of information, including, but not limited to, transaction data, accounts, personal data and the exchange of information with police, security forces, state, intergovernmental and supranational institutions, representations (except tax authorities), departments or regulatory authorities or organizations (including but not limited to the authorities that are listed below in the table under the heading of "Authorities") or third parties, including group companies, if we believe that they are suitable to investigate cases of fraud or other unlawful or potentially unlawful activity, as well as violations of our terms and conditions (including your credit card and/or EC card provider or other account payment source). If you give us false or inaccurate information and we determine a fraud, we shall share the relevant data with appropriate agencies to prevent fraud and/or to law enforcement agencies. We and other organisations can use this data (including data from other countries) to prevent fraud and money laundering.
• Disclosure due to credit card regulations or on the basis of a criminal or civil process.
• Disclosure of aggregate statistics to our business partners or PR partners. For example, we disclose that a certain percentage of our members live in Munich. However, this aggregate information does not include any personal details.
  Just as with other companies, it is possible that PAYMILL may enter mergers in future or be taken over by another company. During such a takeover, you give permission for the successor company to receive access to the information maintained by PAYMILL, including information about the member accounts. The successor company is however still bound by the data protection policy, unless it is modified accordingly.

Our contact with merchants

We usually communicate with our merchants via e-mail or phone to provide the requested services: during the processing of customer complaints, to respond to customer inquiries, to inform you that we believe your user account is used for an unauthorized purpose, to confirm information about you, your business or account transactions, for debt collection, to conduct customer surveys or investigate suspicious transactions.

We use your e-mail address or postal address to confirm the opening of your user account, to send you notifications about, for example, the receipt or the debiting of payments via PAYMILL (including referral bonus payment, as described below), to inform you about important changes to our products and services, and to send you notices and other statutory notifications. Members generally cannot choose which messages they would like to receive. However, the messages are sent mainly for informational purposes and not for advertising purposes.

In connection with independent audits of our financial statements and transactions, the auditors may contact some of our customers to confirm the correctness of our documents. The auditors may not however use personal information for secondary purposes.

4. Information security

The security of your account also depends on how well you protect your password. Do not share your password with anyone. You will never be requested by PAYMILL employees to provide your password. Therefore, you can consider e-mails or other messages in which you are asked for your password as unauthorised and suspicious and we ask you to forward them to [email protected].
If you still pass your password on to another person for specific reasons, this person gains access to your user account and your personal information, and you are responsible for all activities carried out using your password. If you believe that someone else has access to your password, change it immediately by logging into your user account at www.paymill.de and making changes in the profile settings. You should also notify us immediately as described above.

5. Accessing and changing your personal information

You can check the personal information you provided at any time and change this data for your PAYMILL account only with a written statement. You can close your account only with a written statement.

If you cancel your account, your information will not be used or sold or given to third parties for other purposes unless it can help us avoid fraudulent activities or we are obliged to do so in the course of criminal proceedings or by law.

6. Protection of customer data

PAYMILL is a service that is only sucessful with the trust of our company in its customers and vice versa. The protection of your personal data is therefore a very important and special concern of ours.

Principle: Trustworthy handling of your data

PAYMILL handles the data submitted by you carefully and conscientiously. Collection, processing and use of your data is carried out exclusively in accordance with the legal provisions, or in the event of your express consent. Your personal data and the personal data of others, which you provide to us, will not be sold, rented or given away to third parties for other economic reasons, for example for marketing purposes.

Personal data consists of individual details about personal or factual circumstances. As far as personal data or transaction data is communicated to PAYMILL, they will be used exclusively for processing of contracts paid via PAYMILL.

Technical safety

The server on which PAYMILL is operated is located in the secured data center of an Internet service provider resident in the Federal Republic of Germany, and it is secured against unauthorized access. Only authorized employees of PAYMILL and of the responsible Internet service provider, who are obliged to maintain confidentiality and data secrecy, have access to the data processing systems.

7. Right of access

According to the Federal Data Protection Act, you have the right to gratuitous information about your stored data, as well as, where appropriate, the right to correct, block or delete such data.

8. Website Tracking

To make our website more attractive and to establish the use of certain functions for you we use cookies on some pages of our website. Your IP address is reduced by Google basically within the Member States of the European Union or in other States of the European Economic Area. Furthermore, PAYMILL uses pixels or transparent GIF files for evaluation and to support online marketing measures. These GIF files are provided by our advertising management partners. With these files, a unique cookie can be detected on your web browser to enable us to find out which advertisements bring users to our website. The cookie was placed by us or by another advertising customer. The information collected with cookies, Spotlight or Floodlight technology and shared is anonymous and not personally identifiable. It does not contain your name or your address, telephone number, or e-mail address.

This website is using the online advertising programme “Google AdWords” for conversion tracking. Every time a user clicks on a Google advertisement, a cookie is set for conversion tracking. These cookies stop being valid 30 days after activation and are not used for identification purposes. If users visit certain pages of this website when the cookie is still valid, both PAYMILL and Google are notified that the user clicked on an advertisement and was transferred to the promoted page. Each Google AdWords customer is given a unique cookie- therefore cookies cannot be tracked across different websites by AdWords customers. The information gathered through these conversion cookies are used to create. conversion metrics for AdWords customers who choose to track conversions. The customers are told the total number of users who clicked their advertisement and subsequently were referred to a website containing a conversion tracking tag. However, they do not receive any information that could lead to the personal identification of the user. Users who do not want to be tracked nonetheless can easily deactivate the cookie created by Google Conversion Tracking in the user settings of their internet browser.
